2. Services Description

Nasal Inc. provides a platform for digital scent detection, including hardware devices that capture scent data, software applications that process and analyze this data, and a network that enables collective scent intelligence through a community of users. Our Services may include:

• Sale and distribution of scent detection hardware ("Nosy Devices")

• Access to software applications and APIs related to scent detection

• Participation in our decentralized scent data collection network

• Access to our Large Essence Model (LEM) and related artificial intelligence services

• Participation in Scent Missions and other community initiatives

• Use of tokens or other incentive mechanisms for platform participation

3. User Accounts and Registration

To access certain features of our Services, you may need to create an account. You agree to:

• Provide accurate, current, and complete information

• Maintain and update your information as necessary

• Keep your account credentials secure and confidential

• Accept responsibility for all activities occurring under your account

4. Hardware Devices

4.1 Purchase and Ownership

When you purchase a Nosy Device, you own the physical device, but Nasal Inc. retains ownership of the software, firmware, and other intellectual property incorporated into the device.

4.2 Warranty

Hardware devices come with a limited warranty as specified in our Warranty Policy. This warranty does not cover damage resulting from misuse, accidents, unauthorized modifications, or normal wear and tear.

4.3 Acceptable Use

You agree to use Nosy Devices in compliance with all applicable laws and regulations. Prohibited uses include:

• Detecting substances for illegal purposes

• Reverse engineering the device or its components

• Modifying the device's software or firmware without authorization

• Using the device in a manner that could harm individuals or property

5. Data Collection and Use

5.1 User-Contributed Data

When you use a Nosy Device to capture scent data and contribute it to our network, you grant Nasal Inc. a worldwide, non-exclusive, royalty-free license to use, process, store, and analyze such data for purposes including:

• Training and improving our Large Essence Model (LEM)

• Operating and improving our Services

• Creating aggregated or anonymized datasets

• Research and development of scent recognition technology

• Providing analytics and insights to our users and partners

5.2 Data Quality and Validation

We use Proof of Emergent Measurements (PoEM) and other validation mechanisms to ensure data quality. We reserve the right to reject data submissions that do not meet our quality standards or appear to be fraudulent.

5.3 Privacy

Collection and processing of personal data is governed by our Privacy Policy. By using our Services, you consent to our data practices as described in that policy.

6. Intellectual Property

6.1 Nasal Inc. IP

All intellectual property rights in the Services, including patents, trademarks, service marks, trade names, and copyrighted content, are owned by Nasal Inc. or its licensors. Nothing in these Terms grants you any right to use our intellectual property without our prior written consent.

7.1 Token Issuance

Nasal Inc. may issue digital tokens or other rewards as incentives for participation in our platform. These tokens may be subject to separate terms and conditions.

7.2 No Investment Offering

Tokens issued by Nasal Inc. are utility tokens intended to facilitate platform participation and are not offered as investments or securities. The value of tokens may fluctuate, and we make no guarantees regarding their future value.

7.3 Regulatory Compliance

Token usage is subject to applicable laws and regulations. We reserve the right to modify our token system or restrict access in certain jurisdictions to comply with regulatory requirements.

8. Limitation of Liability

To the maximum extent permitted by law, Nasal Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, resulting from:

In no event shall our total liability to you for all claims exceed the amount you have paid to Nasal Inc. in the preceding 12 months.
